PLANNING COMMISSION

REGULAR MONTHLY MEETING

March 12, 2008

 

 

The New Hanover Township Planning Commission held its regular monthly meeting on March 12, 2008 in the New Hanover Township Municipal Building, 2943 North Charlotte Street, Gilbertsville, PA 19525.  Richard Mulstay led in a Salute to the Flag and called the meeting to order at 7:00 PM.

Also present were Township Manager Edward Wagner, Township Solicitor Paul Bauer, Township Engineer Douglas Brown, Planning Consultant Adam Supplee and Maryann Brennan.

 

Work Items – None

MINUTES – ­­­ Robert Thomas moved to approve the February 13, 2008 Regular Meeting minutes.  Motion was seconded by Susan Smith and unanimously carried.

Business For Discussion or Action:

 

 N.H.T.P.C. No. 736 Mann Tract, 7 Lots Little Road  - Estelle Eberhardt and Carl Weiner were present seeking final plan approval.  Estelle Eberhardt questioned the Fire Chief’s letter regarding providing some sort of assistance in conjunction with the other developers in getting the pond at the Schultz Road Park to hold water for use in fire protection for the north end of the township.  Ed Wagner said he is waiting for a price from Richard Mast who is designing this project.    Richard Mulstay brought up the issue of inspection needed for the bridge on Woodland Road.  An area resident has raised the question of the conditions of the bridge and what impact the Mann subdivision will have on the existing structure.  Ed Wagner has been discussing this matter with Pete Hiryak of Douglass Township.  The Douglass Township Supervisors have requested an inspection of the infrastructure, in the interest of public safety.  To their knowledge, the bridge has never been inspected.   Douglass Township contacted Penn Dot to incorporate the Woodland Road Bridge in their two year bridge inspection schedule.  However, Penn Dot has declined to inspect the bridge because it is too small and narrow for their criteria but suggested that a private firm could be contacted for the inspection.  Pennoni Associates was one of the firms recommended and contacted by Douglass Township.  The inspection, analysis and report will cost approximately $3,500.00.   Paul Bauer asked Carl Weiner if his client was willing to pay for this cost and Mr. Weiner answered “no, his client has already paid for off site improvements and these six lots would not have any impact on the bridge”.  Susan Smith moved to recommend approval for NHTPC No.736 in final form to the Board of Supervisors conditioned upon compliance with the Engineer Brown’s letter of February 19, 2008, Planner’s letter of March 3, 2008 and Fire Chief’s letter of March 4, 2008.  Bob Thomas seconded the motion and it unanimously carried.

 

N.H.T.P.C. No. 692 Sterling Tract, 10 Lots, Rabbit Run Road -  Estelle Eberhardt and Carl Weiner  were present seeking final plan approval.  Bob Thomas asked if the temporary cul-de-sac will go away.  Estelle answered “yes, and this will be put back to lawn on Lot 6”.  Susan Smith said she was concerned with the thirty-five-foot buffer affecting the rear yards and questioned whether the property owners would have usable space.  After much discussion it was decided to allow a Class A buffer ten feet wide in lieu of thirty-five-foot wide Class B buffer along the northern perimeter of the property and also to allow existing vegetation along the southern and western property perimeters to serve as a buffer in lieu of additional plantings.  Susan Smith and Bob Thomas questioned the sidewalk ending on the south side of Rabbit Run.  After much discussion it was decided to eliminate the sidewalk on this side and to pay a fee in lieu of installation of such sidewalk.  Phil Agliano moved to recommend the Board of Supervisors grant the waiver requests relative to the ten foot buffer width along the northern perimeter and elimination of the sidewalk on the south side of Rabbit Run. The motion was seconded by Robert Thomas and unanimously carried.  Phil Agliano motioned  to recommend approval for NHTPC No. 692 in final form to the Board of Supervisors conditioned upon compliance with Engineer Brown’s letter of February 19, 2008, Planner’s letter of March 3, 2008, Traffic Engineer letter of February 25, 2008 and Fire Chief letter of March 5, 2008. The motion was seconded by Kenneth Hansell and unanimously carried.

    

N.H.T.P.C. #750 Gerald Kulp, 3 Lots  -  Ed Wagner wanted to discuss the revised sketch plan John Aston submitted.  The Planning Commission agreed they do like this design much better, but would like to see the New Hanover Lutheran Church’s out building added to the plan.  The Planning Commission is agreeable to a reduced15’ buffer (from the required 35’) between Lots 1 and 3 and the neighboring property.

 

 

Planning Module Component 4A’s

 

N.H.T.P.C. #734 Rosenberry Ridge, 15 Lots – Ken Hansell moved to recommend approval of Component 4A of the Planning Module for N.H.T.P.C. #734.  Bob Thomas seconded  the motion and it unanimously carried.

 

 

Business for Action on 90 Day Time Limitation Waivers

Ken Hansell moved to recommend to the Board of Supervisors that they deny N.H.T.P.C. numbers 563, 714, 734, 742 and 744 as listed below, based on the professional consultant’s comments and subject to receipt and approval by the Board of Supervisors of a ninety-day waiver of the time limit.  Susan Smith seconded the motion and it unanimously carried.

OLD BUSINESS 

 

Riparian Corridor Conservation District Ordinance – Ed mentioned that this is a revised version of the Riparian Corridor Conservation District Ordinance.  The Planning Commission approved the first draft last summer but the township solicitor wanted to add suggestions from the Montgomery County Planning Commission into the proposed ordinance.  Paul mentioned that by adding the county’s suggestions, makes it overall a better ordinance.  All members of the Planning Commission agreed with Paul’s comments.  The public hearing to adopt the proposed ordinance is scheduled for Monday, April 14th at 7:00 P.M.  Ken Hansell moved to recommend approval to the Board of Supervisors for the proposed ordinance.  Phil Agliano seconded the motion and it unanimously carried.

The New Hanover Township Planning Commission held its regular monthly meeting on February 13, 2008 in the New Hanover Township Municipal Building, 2943 North Charlotte Street, Gilbertsville, PA 19525.  Richard Mulstay led in a Salute to the Flag and called the meeting to order at 7:00 PM.

MINUTES – Robert Thomas  moved to approve the minutes of the January 9, 2008 regular monthly meeting.  Philip Agliano  seconded the motion, and it unanimously carried.

Business For Discussion or Action:

 N.H.T.P.C. No. 738 Yothers, 4 Lots Housman Road  - John Aston was present stating that his client is interested in learning what potential improvements may be required.  After being advised of the proximity of the location of the quarry proposed in Gibraltar Rock III, applicant decided to suspend review of their plan to reconsider their options.  Paul Bauer explained the recent validity challenge to the Zoning Ordinance by Gibraltar Rock to the Planning Commission members.

 

N.H.T.P.C. No. 710 Renninger, 64 Lots, Middle Creek Road - Nicholas Feola of Bursich Associates, Inc. was present representing the applicant explaining that the daycare facility was removed and replaced with an office building.  Planning Commission members discussed the additional waivers that were listed in their letter of February 11, 2008.  Applicant requests permission to provide all the required plantings but to substitute classifications of buffer yards to provide screening.  Susan Smith expressed concerns regarding buffering occupying residential rear yards and not allowing area for residential accessory uses. After much discussion, Kenneth Hansell moved to recommend approval of the waiver requests.  Phillip Agliano seconded the motion and it unanimously carried 5-0.  Kenneth Hansell moved to recommend approval in preliminary form to the Board of Supervisors conditioned upon compliance with Engineer Brown’s letter of February 5, 2008, Planner’s letter of February 7, 2008, Traffic Engineer letter of February 6, 2008, Gannett Fleming letter of February 7, 2008 and conditioned upon lots 42-47 being given the largest backyard as possible and providing that the applicant revise the landscaping plan to coincide with discussion during Planning Commission meeting prior to final plan approval.  Phillip Agliano seconded the motion and it unanimously carried 5-0. 

             

N.H.T.P.C. No. 750 Gerald Kulp, 3 Lots, N. Charlotte Street   John Aston was present representing this applicant.  Zoning variance was granted by the  Zoning Hearing Board.  Planning Commission members do not agree with the configuration of the three lots and a staff meeting was suggested to discuss options.  Robert Thomas inquired about the state highway permit, was told that application is pending. 

          

 

Planning Module Component 4A’s

Kerr Tract 2143 Little Road- application for dry channel stream discharge system.   Phillip Agliano moved to approve Planning Module 4A.  Robert Thomas seconded the motion and it unanimously carried 5-0.
